Acceptance of Terms
By booking, requesting, or using delivery services from OFL ArtBound (“Company,” “we,” “us,” “our”), the client (“Client,” “you”) agrees to be bound by these Terms & Conditions.
Description of Services
OFL ArtBound provides courier and delivery services for local food creatives, art and creative professionals, and pop-up/market vendors throughout Central Florida.
Service Area
Orlando · Winter Park · Maitland · Sanford · Longwood · Casselberry · Winter Springs · Winter Garden · and surrounding Central Florida communities. Coverage may be adjusted at Company's discretion.
Booking, Rates & Payment
- Deliveries are booked in advance through the website, phone, or booking form; same-day requests may incur a rush fee.
- Pricing follows the applicable service tier (Local Food Creatives, Art & Creative, or Pop-Up and Market) per the current rate card.
- Payment is due at time of booking unless otherwise agreed in writing. Florida sales tax applies where required.
- Additional fees may apply for rush service, oversized items, extended wait times, multiple stops, or after-hours requests.
Cancellation & Refund Policy
- Cancellations 24+ hours before pickup: full refund.
- Cancellations within 24 hours: may incur a cancellation fee of up to 50%.
- No-shows may be charged the full service fee.
Client Responsibilities
- Properly package items for transport, especially fragile artwork or perishable food.
- Disclose item nature, value, and special handling needs at booking.
- Ensure availability for pickup and drop-off at scheduled times.
- Independently comply with Florida food-safety, cottage-food, licensing, and permitting requirements for goods tendered for delivery.
Prohibited Items
Illegal substances, hazardous or flammable materials, weapons, live animals, or anything prohibited under Florida or federal law. OFL ArtBound may refuse any item at its discretion.
Liability & Damage Claims
- Claims must be reported within 48 hours of delivery with supporting documentation.
- Liability is limited to the declared value at booking or $250 per delivery, whichever is less, unless additional coverage is purchased.
- OFL ArtBound is not liable for damage from improper packaging, pre-existing defects, or force majeure delays, nor for indirect or consequential damages (e.g. a missed market slot), to the fullest extent permitted under Florida law.
Force Majeure
OFL ArtBound is not responsible for delays from events beyond its reasonable control, including severe weather (hurricanes/tropical storms), natural disasters, traffic incidents, road closures, or government action.
Governing Law
These Terms are governed by the laws of the State of Florida, including the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), Fla. Stat. § 501.201 et seq. where applicable. Disputes are resolved through good-faith negotiation and, if unresolved, the appropriate court in Seminole County, Florida.
Service Tiers & Delivery Policy
- Local Food Creatives — prepared foods, baked goods, and perishables, from $21/delivery.
- Art & Creative — original artwork, prints, and creative goods, from $34/run.
- Pop-Up and Market — time-sensitive delivery and setup-support logistics, from $58/market day.
Food items follow basic food-safety handling practices consistent with FDACS guidance; Client confirms temperature-control needs at booking. Fragile and artwork items receive additional care. Delivery windows are estimates, not guarantees, and may shift with Florida traffic or weather. OFL ArtBound may use photo confirmation, signature, or recipient verification as proof of delivery.
